Senate Bill S510 Makes it illegal to Grow, Share, Trade or Sell Homegrown Food

S 510, the Food Safety Modernization Act of 2010,  may be the most dangerous bill in the history of the US.  It is to our food what the bailout was to our economy, only we can live without money.

“If accepted [S 510] would preclude the public’s right to grow, own, trade, transport, share, feed and eat each and every food that nature makes.  It will become the most offensive authority against the cultivation, trade and consumption of food and agricultural products of one’s choice. It will be unconstitutional and contrary to natural law or, if you like, the will of God.”  ~Dr. Shiv Chopra, Canada Health whistleblower

It is similar to what India faced with imposition of the salt tax during British rule, only S 510 extends control over all food in the US, violating the fundamental human right to food.

Monsanto says it has no interest in the bill and would not benefit from it, but Monsanto’s Michael Taylor who gave us rBGH and unregulated genetically modified (GM) organisms, appears to have designed it and is waiting as an appointed Food Czar to the FDA (a position unapproved by Congress) to administer the agency it would create — without judicial review — if it passes.  S 510 would give Monsanto unlimited power over all US seed, food supplements, food and farming.

History

In the 1990s, Bill Clinton introduced HACCP (Hazardous Analysis Critical Control Points) purportedly to deal with contamination in the meat industry.  Clinton’s HACCP delighted the offending corporate (World Trade Organization “WTO”) meat packers since it allowed them to inspect themselves, eliminated thousands of local food processors (with no history of contamination), and centralized meat into their control.  Monsanto promoted HACCP.

In 2008, Hillary Clinton, urged a powerful centralized food safety agency as part of her campaign for president.  Her advisor was Mark Penn, CEO of Burson Marsteller*, a giant PR firm representing Monsanto.  Clinton lost, but Clinton friends such as Rosa DeLauro, whose husband’s firm lists Monsanto as a progressive client and globalization as an area of expertise, introduced early versions of S 510.

S 510 fails on moral, social, economic, political, constitutional, and human survival grounds.

1.  It puts all US food and all US farms under Homeland Security and the Department of Defense, in the event of contamination or an ill-defined emergency.  It resembles the Kissinger Plan.

2.  It would end US sovereignty over its own food supply by insisting on compliance with the WTO, thus threatening national security.  It would end the Uruguay Round Agreement Act of 1994, which put US sovereignty and US law under perfect protection.  Instead, S 510 says:

COMPLIANCE WITH INTERNATIONAL AGREEMENTS.

Nothing in this Act (or an amendment made by this Act) shall be construed in a manner inconsistent with the agreement establishing the World Trade Organization or any other treaty or international agreement to which the United States is a party.

3.  It would allow the government, under Maritime Law, to define the introduction of any food into commerce (even direct sales between individuals) as smuggling into “the United States.” Since under that law, the US is a corporate entity and not a location, “entry of food into the US” covers food produced anywhere within the land mass of this country and “entering into” it by virtue of being produced.

4.  It imposes Codex Alimentarius on the US, a global system of control over food. It allows the United Nations (UN), World Health Organization (WHO), UN Food and Agriculture Organization (FAO), and the WTO to take control of every food on earth and remove access to natural food supplements.  Its bizarre history and its expected impact in limiting access to adequate nutrition (while mandating GM food, GM animals, pesticides, hormones, irradiation of food, etc.) threatens all safe and organic food and health itself, since the world knows now it needs vitamins to survive, not just to treat illnesses.

5.  It would remove the right to clean, store and thus own seed in the US, putting control of seeds in the hands of Monsanto and other multinationals, threatening US security. See Seeds – How to criminalize them, for more details.

6.  It includes NAIS, an animal traceability program that threatens all small farmers and ranchers raising animals. The UN is participating through the WHO, FAO, WTO, and World Organisation for Animal Health (OIE) in allowing mass slaughter of even heritage breeds of animals and without proof of disease.  Biodiversity in farm animals is being wiped out to substitute genetically engineered animals on which corporations hold patents.  Animal diseases can be falsely declared.  S 510 includes the Centers for Disease Control (CDC), despite its corrupt involvement in the H1N1 scandal, which is now said to have been concocted by the corporations.

7.  It extends a failed and destructive HACCP to all food, thus threatening to do to all local food production and farming what HACCP did to meat production – put it in corporate hands and worsen food safety.

8.  It deconstructs what is left of the American economy. It takes agriculture and food, which are the cornerstone of all economies, out of the hands of the citizenry, and puts them under the total control of multinational corporations influencing the UN, WHO, FAO and WTO, with HHS, and CDC, acting as agents, with Homeland Security as the enforcer.  The chance to rebuild the economy based on farming, ranching, gardens, food production, natural health, and all the jobs, tools and connected occupations would be eliminated.

9.  It would allow the government to mandate antibiotics, hormones, slaughterhouse waste, pesticides and GMOs. This would industrialize every farm in the US, eliminate local organic farming, greatly increase global warming from increased use of oil-based products and long-distance delivery of foods, and make food even more unsafe.  The five items listed — the Five Pillars of Food Safety — are precisely the items in the food supply which are the primary source of its danger.

10. It uses food crimes as the entry into police state power and control. The bill postpones defining all the regulations to be imposed; postpones defining crimes to be punished, postpones defining penalties to be applied.  It removes fundamental constitutional protections from all citizens in the country, making them subject to a corporate tribunal with unlimited power and penalties, and without judicial review. It is (similar to C-6 in Canada) the end of Rule of Law in the US.

In case you have been getting confused or pacified because of the amendments:

The “small farms” exclusion will soon be meaningless
The Tester Amendment of the bill did manage to exclude some smaller farmers from the more tyrannical provisions of the bill. As currently stated, this would exclude small farms that sell less than $500,000 worth of food and which sell most of their food locally.
However, Senators failed to consider what’s going to happen when the Federal Reserve keeps printing counterfeit money, devaluing the dollar and causing massive food price inflation. A farm that right now produces merely $100,000 worth of food (which could be a small, two-person farm) will soon find itself producing $500,000 worth of food (or more) due to the rapidly falling value of the U.S. dollar.
This is how the Federal Reserve’s money counterfeiting actions will further destroy America and place small family farms under the tyranny of the FDA.

    first, my qualifications: i am literate. i studied literature at the university and graduated magna cum laude with a bachelor of arts degree; i worked 18 years as a science/engineering writer/editor; i am a professional writer with experience in political writing.

    i just now spent more time than i should have trying to sort this out. i reviewed S510 at the web site specified above, and i have come to the following tentative conclusions:

    the World’s Prophecy article makes scary claims about the dangers of the bill without quoting a single phrase from the actual bill; i find this hugely offensive and irresponsible.

    quoting the summary of the bill (as some of the reviewers above have done) is meaningless. the summary can say whatever it wants, and can easily consist of propaganda, and i believe that this particular summary does indeed consist of propaganda; the stuff that matters is in the text of the bill, not in the summary.

    the snopes article cited above on this topic is not reliable. for one thing, the snopes article addresses HR875/S425, not S510, and though there are significant differences, i do not know what all of the differences are. snopes needs to revisit the topic and address the most recent version, which appears to be S510. snopes correctly discredits some outlandish claims about the dangers of the food safety modernization act, claims other than and more exaggerated than those made by the WP article above. however, snopes cites Rep. DeLauro’s myths and fact sheet for HR875, and i found the fact sheet to be plainly inaccurate in relation to S510. besides, Rep. DeLauro is the primary sponsor of the bill and clearly has a motive to promote it, disingenuously if need be. further, the snopes article fails to actually quote a single phrase from the bill that might actually support the claims of its opponents; such phrases do exist, even in HR875. Further, S510 includes provisions far more alarming to its opponents than any i was able to find in a quick review of HR875.

    S510 plainly gives a lot of authority to the bureaucrats to write new regulations. this phenomenon is always a problem to people who cherish their freedom, and concern in this regard is fully justified.

    S510 specifically applies to small businesses and even, in at least one instance, to “a very small business,” whatever that means. for example:

    “(3) CONTENT.—The proposed rulemaking under paragraph (1) shall—
    “(A) provide sufficient flexibility to be applicable to various types of entities engaged in the production and harvesting of raw agricultural commodities, including small businesses and entities that sell directly to consumers, and be appropriate to the scale and diversity of the production and harvesting of such commodities;
    “(B) include, with respect to growing, harvesting, sorting, packing, and storage operations, minimum standards related to soil amendments, hygiene, packaging, temperature controls, animal encroachment, and water;
    “(C) consider hazards that occur naturally, may be unintentionally introduced, or may be intentionally introduced, including by acts of terrorism;

    another example:

    (b) Regulations.
    (1) IN GENERAL.—Not later than 18 months after the date of enactment of this Act, the Secretary of Health and Human Services (referred to in this Act as the “Secretary”) shall promulgate regulations to establish science-based minimum standards for conducting a hazard analysis, documenting hazards, implementing preventive controls, and documenting the implementation of the preventive controls under section 418 of the Federal Food, Drug, and Cosmetic Act (as added by subsection (a)).
    (2) CONTENT.—The regulations promulgated under paragraph (1) shall provide sufficient flexibility to be applicable in all situations, including in the operations of small businesses.

    another example:

    (2) EXCEPTIONS.—Notwithstanding paragraph (1)—
    (A) the amendments made by this section shall apply to a small business (as defined by the Secretary for purposes of this section, not later than 90 days after the date of enactment of this Act) after the date that is 2 years after the date of enactment of this Act; and
    (B) the amendments made by this section shall apply to a very small business (as defined by the Secretary for purposes of this section, not later than 90 days after the date of enactment of this Act) after the date that is 3 years after the date of enactment of this Act.

    i found evidence that S510 regulations that will apply to domestic food production will not apply to imported food. in other words, it is likely, for example, that imported food will be subject to regulations far more lax than those imposed on domestic producers, handlers, and marketers. specifically:

    SEC. 404. COMPLIANCE WITH INTERNATIONAL AGREEMENTS.
    Nothing in this Act (or an amendment made by this Act) shall be construed in a manner inconsistent with the agreement establishing the World Trade Organization or any other treaty or international agreement to which the United States is a party.

    in summary: the fear mongers have a good case, but they represent themselves and their case very poorly, and thus detract significantly from their credibility.

    the thing that bothers me so much is that the majority of the united states citizens fought obama’s health care bill tooth and nail…with every ounce of strength they had…we effectively drug it out, attended town halls, wrote letters, faxed faxes, rallied friends, we did everything we are “supposed” to do in this “free” society to stop a bill we didn’t like (it is NOT that we didn’t want good healthcare in our country, but we did not think obamacare was the way at all, it would destroy our country) it did not matter what we did, in the end, they found a tricky way to waltz around the constitution and the law of the land, and the bill passed anyway…we did not have one speck of power…that is what is most wrong with our country…the laws are opposite of what people want and need and the lawmakers are lawless…the exact same thing happened with the “stimulus package” i have spent hours and hours, sleepless nights rallying friends, typing letters, phoning offices with overflowing voice mail and over flowing email…never to even get my message to the right person…and the bill, the UNREAD bill, with every other kind of crap that has nothing to do with healthcare in it, PASSED anyway, everyone buckled…we are NOT represented by our representatives….the system is broken and until we refuse to accept it the way it is, then it will keep on enslaving us…the food “safety” bill is just another example…we might as well just die right now if they take away our right to grow food…already you cannot get food without pesticides on them or in them, you cannot find prepared foods without chemicals, additives and poisons in them…MSG IS A NEUROTOXIN yet it is hidden in all our food in plain sight in the ingredient list (hydrolzyed yeast extract, natural flavors, spices…ALL code names for MSG) this is a farce…it is not OUR government…it is not freedom, liberty, or happiness. but it only takes the removal of one block at the bottom of the pyramid for the entier pyramid to topple…one domino fells the entire line of dominos…we MUST stop this tyrrany…our forefather’s died for naught if we do not take up the cause…

    The bill constantly refers to “food facilities” or “domestic food facilities”. In order to be a food facility, you must register with the FDA in accordance to Public Health Security and Bioterrorism Preparedness and Response Act of 2002. According to the FDA, you DO NOT have to register if:

    •Private residences of individuals, even though food may be manufactured/processed, packed, or held in them.
    •Farms — i.e., facilities in one general location devoted to growing and harvesting crops and/or raising animals (including seafood). The term “farm” also includes facilities that manufacture/process, pack, or hold food, provided that all food used in those activities is grown, raised, or consumed on that farm or another farm under the same ownership.

    Unless I missed it, the bill doesn’t change those terms. Please try and read the bills (not the summaries or someone’s interpretation) for yourselves before jumping on the bandwagon.

    Your home garden will not get regulated, nor will any private or small farms. When you fear monger without reason, you become just as bad as those that you rally against.

    @ cautiously nameless there were also more than 15 million people worldwide out marching against the war that W started illegally, and you know what happened? we went to war anyway. so when the pol’s see that they can do what they want no matter how many people protest ,in that case it was waging war, now it’s health care and then it’s the food supply. ihatevery1 seemed to be onto what and how they do it, make a big flourish which gets a lot of attention, then make a few concessions and then bingo, they have our food supply by the shorties.

    Anyone else think that maybe this bill has more to do with the marijuana? Once its is made legal in California and so on which will happen within the decade all of these regulations will be needed in order to prevent people from growing the plant in their backyard and opening up a roadside shop selling the stuff. As well as preventing foriegn countries from importing their cheaper grown, cheaper sold marijuana.

    In section 201 and 202 try saying marijuana facility rather than food facility and substituting the word marijuana for the word food throughout the rest of the article. I think this is a bill regulating marijuana growth and importation under the words “crop” and “food”, which it will be considered once it is made legal.

    Its also a bill which is setting up an emergency recall program in case of a mass poisoning.

    It is also a bill regulating (including) small farms as well as the big farms.

    There is nothing in this bill stating that you will not be able to grow a home garden for your own personal consumption. That garden includes whatever vegetables and herbs including marijuana.

    They need to have some sort of regulations so that we dont have every joeblow out there peddling their homegrown marijuana on every street corner.

    Think about it before you go be”lie”ving people…

  33. I guess I’ll be going to jail or prison or whatever comes first, when someone comes along and tells me I can’t grow fruit and vegetables from my own garden. Its a hell of alot safer then whats coming from farm growers around the world. Hell will freeze over before I commit to this S510 bill. By the way I consume what I grow, I don’t sell my food. Government wants to control every aspects of our lives.

    I for one am appalled that 5000 Americans die every year from eating contaminated food. If a government agency takes reasonable measures to reduce that number, I support it wholeheartedly. I believe S-510 is a reasonable measure.

  39. There must be an amount of personal responsibility taken by every American to pay attention to what they consume. More regulations will not fix these issues any more than more regulations “fixed” Katrina victims, the oil spill, the bank bailouts, etc.. Common sense on the part of the individual MUST be stressed in our childrens education, NOT reliance on a goverment to tell us when its safe to cross the road, or buy milk from a shady establishment. Our grandparents would be ashamed, and I suggest that if you still have grandparents, that you ask their opinion.
